Terms of Service

1. Who you are agreeing with

These terms are between you and the operator of nof1.fit and the N of 1 application:

Using the site, joining the waitlist, or signing in to the application means you accept these terms. If you do not, do not use it.

2. What the service is

N of 1 collects a single subject’s health, training, nutrition and productivity data into one record and displays it back to them. It runs in cohorts: Cohort 001 is one subject over 90 days, and intake is closed while a cohort is running.

There is no public signup. Access is granted by invitation, one subject at a time. Joining the waitlist creates no account, no entitlement and no contract — it is a request to be told when a seat opens, nothing more.

3. Not medical advice

N of 1 is not a medical device, is not certified as one, and does not diagnose, treat, cure or prevent any condition. Every score, trend, correlation and derived value it shows is an observation about data you supplied, produced by formulas that can be wrong, from sensors that can be wrong.

Decisions about training, nutrition, supplements, medication or medical care are yours, and should be made with a qualified professional. Do not delay seeking medical attention because of something this application displayed. If you think you may be having a medical emergency, contact emergency services.

4. Eligibility and your account

• You must be at least 18 years old.
• An account belongs to one subject. Do not share credentials — the data behind them is health data.
• Keep your password to yourself and tell us at office@divex.ai if you think someone else has it.
• Connect only accounts you own, and enter only data about yourself. Do not upload another person’s health data without their explicit consent.

5. Your data

The data you enter or connect remains yours. You grant DIVEX only the permission needed to run the service for you: to store that data, transform it into the application’s own format, compute derived values from it, and show it back to you.

No ownership is claimed over it, it is not sold, and it is not used to train models. If aggregate results of an experiment are ever written up publicly, they are published without personal identifiers and only with the subject’s agreement. Ask for an export or a deletion at any time; see the Privacy Policy.

6. Third-party integrations

Connecting WHOOP, Apple Health, a nutrition app or any other source is optional and always your choice. Those services have their own terms and privacy policies, and your use of them is governed by those, not by these terms.

N of 1 is an independent project. It is not affiliated with, endorsed by, sponsored by or certified by Whoop, Inc., Apple Inc., or any other provider named in the application; their names and marks belong to them and are used only to say what connects to what. If a provider changes or withdraws its API, the corresponding feature may stop working, with no liability on our side.

7. Acceptable use

• Do not attempt to access another subject’s data, probe the service for vulnerabilities without permission, or disrupt its operation.
• Do not scrape it, resell access to it, or use it to provide a service to someone else.
• Do not upload unlawful content or anything you have no right to submit.

Found a security problem? Report it to office@divex.ai before doing anything else with it. Good-faith reports are welcome and will not be met with legal action.

8. Availability

The service is provided on a best-effort basis, with no service-level agreement. It can be unavailable for maintenance, change substantially between cohorts, or be discontinued. If it is going to be shut down, subjects with an account are given reasonable notice and an export of their data first.

9. Cost

Participation in a cohort is currently free of charge. If that ever changes, you will be told before any fee applies, and no fee will be charged for data you have already put in.

10. Ending it

You can stop at any time and ask for your account and data to be deleted. Access may be ended if these terms are breached, if a cohort finishes, or if the service is discontinued. Deletion is permanent — an export beforehand is the only copy you will get.

11. Warranties and liability

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and the accuracy or completeness of any measurement, score or derived value.

To the maximum extent permitted by law, DIVEX is not liable for indirect or consequential damages, lost profits, or loss of data, nor for decisions taken on the basis of anything the application displayed. Nothing in these terms excludes liability that cannot be excluded by law — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law, and your statutory rights as a consumer are unaffected.

12. Changes to these terms

These terms may change. The date at the top changes with them, and anyone with an account is told by email before a material change takes effect. Continuing to use the service after that means the new terms apply.

13. Law and disputes

These terms are governed by Romanian law, and the courts of Romania have jurisdiction, without depriving a consumer of the protection of the mandatory law of their country of residence. EU consumers may also use the European Commission’s online dispute resolution platform.
